Transparent Tender Entering Finale

The company Trnavská stavebná spoločnosť, a.s., acting under its new trade name TSS GRADE, a.s. from 1.1.2011, and its opponent ŽSR as the contracting entity in public tender, submitted their respective pleadings to the Commission.

BRATISLAVA, 21 January (WBN/PR) – By the verbal hearing held at ÚVO on 19.1.2011, the tender for the Nové Mesto nad Váhom – Púchov railway corridor between km 100.500 – 159.100, Stage 3 - Zlatovce – Trenčianska Teplá section, called for increasing the railway traffic speed to up to 160 km/h, entered its final phase.  The parties participating, Trnavská stavebná spoločnosť, a.s., acting under its new trade name TSS GRADE, a.s. from 1.1.2011 as claimant, and ŽSR as the contracting entity in public procurement and as opponent, submitted their respective pleads in defence of their positions to the Commission. The close-to unending fight, commenced by calling for bids in the December 2009 tender and opening the offers in March 2010, until now brought continuous attacks about, lately concentrating mainly to the ranking-order issue of the first two tenderers. The participants of this public tender were using all available legal options.

TSS GRADE a.s. ceased to believe that the rules of fair contest and non-discrimination of participants would be upheld if the company exercised its right to request legality examination of the procedure, therefore it decided withdrawing the objections filed with ÚVO on 30.12.2010.

We are not going to reconcile with the necessity to close, at this age of transparency, both eyes before the truth. Justice, in Slovakia, is a commodity virtually impossible to obtain, therefore we will utilize further legal instruments and options uncompromisingly in the provision of justice, revelation and substantiation of suspicions too numerous in this tender. We believe in the existence of justice.
